BDRC hears only matters properly before it. The Center does not issue summonses or demands to appear. Every proceeding rests on the agreement of the parties, a dispute resolution provision in their contract, or the order of a court.
Consent
The Center accepts a matter on one of three bases: the written agreement of all parties to arbitrate or mediate before BDRC, an existing dispute resolution provision designating BDRC, or a court order compelling arbitration before it.
Intake
A party initiates a matter by email to the Center's Administrator, copying all parties, and identifying every party and their counsel or to'anim, together with the arbitration agreement, the parties' consent, or the court order. The Administrator performs conflict checks and informs the parties whether BDRC is prepared to handle the matter. If it is, the claimant pays the case initiation fee.
Empanelment
BDRC empanels three neutrals unless the parties agree to a single neutral, matched to the subject matter of the dispute. The Center schedules a preliminary conference.
Preliminary Conference
In advance of the conference, the parties submit a concise statement of the dispute, the documentary evidence and witnesses they expect to present, and any requested discovery. The panel then sets a schedule for focused document exchange and pre-hearing submissions, and fixes hearing dates.
Hearings
The parties present their case in an orderly and efficient manner through testimony, documents, and argument before the panel.
Resolution & Enforcement
The proceeding ends in an enforceable result: a written, reasoned award, or a binding settlement agreement reached in mediation, each issued after a process that meets the law's demanding standards of fairness. Awards may be confirmed under CPLR Article 75 or the Federal Arbitration Act and entered as judgments of the court.

Rabbi Yakov Markowitz, Esq.
Rabbi Markowitz is an attorney and an experienced rabbinical court arbitrator who has presided over a wide range of commercial disputes. A former Assistant District Attorney, his practice concentrates on commercial litigation.
Leopold Gross, Esq.
Mr. Gross is a veteran commercial litigator and criminal defense attorney with substantial experience in arbitration. He has handled complex commercial disputes in courtrooms and hearing rooms for decades.
Israel T. Appel, Esq.
Mr. Appel is a commercial litigator and former law professor whose practice includes substantial arbitration work, including proceedings before rabbinical courts and matters involving the law of arbitration itself, from confirmation through challenge.
Solomon Neuwirth, Esq.
Mr. Neuwirth is an attorney and entrepreneur who has built and operated businesses as well as counseled them. He brings to the panel the commercial judgment of someone who has sat on the business side of the table, joined to a lawyer's rigor.
